Will I be caught if I use the LT1995 or any other LUL stock for my Anasville Subway and use it as a public release?

If you even have to ask this question, it surely begs as to
your overall motivations.
There are certainly ways that authors can add unique identification to visual files like .Bmps and other formats as well as to audio files. Even files like the train.dat can be uniquely identifed.
You can bet that any project you release to the public would
recieve a high order of scrutiny and you would be caught quickly
if you used material that didn't belong to you.
Personally I'm going to ask Nels' to take a closer look at your
posts and act accordingly. I certainly don't see your current activities as acting in accordance with the forum rules.

Will you be caught if you modify it without permission? Of course.
I think maybe you meant to ask a different question. Given that's correct:
If you simply build your route using this as the base train, and simply place the train in the Train.Folder statement, there is absolutely nothing wrong with that, and honestly, your best option.
I hope you meant the latter. If your intended question was 'will i get caught if I change around the LT1995 and use it for my routes' then I truly apologize to myself for wasting the time to post this and to the supporters of this site for wasting the bandwidth to do so.

Theres nothing wrong with using an UNMODIFIED train as the default traction - just inform people where they can download it from in the readme file.

So to sum up, if I use the LT1995 as normal then I won't have action taken against me as long as the author knows, yeah?

If you use it as it is you don't need to notify the author at all. Though it's not a bad idea, it's certainly not required.
I don't think there has been an instance yet in which someone has been disappointed by the use of their trains.

Guys, let's get one thing straight and spread the word, ok? The last
thing Nels is worried about is bandwidth and crossposting. You
can start as many topics as you want as long as they remain topical
to BVE. This isn't CroTrainz and knowing this might prevent some
needless flame wars in the future. (I'll be expanding on this in
a separate post.)

In summary, that would be your best course of action. I personally
would notify the author of the train by email, that would make it
easier for him/her to check the file to make sure it's still
downloadable, and that the links are current.

Erm... You are telling the whole world that you are using the 1995 stock now, right? So, if they see a train included, they will check and see whether it is a modified 1995 stock.

I don't think he's going to release the LT1995 with the route, he's
just going to use it as the default train.

I think the way you worded your original post was causing concern to be honest, ie: "Will I get caught?".
Like most have said, simply selecting a train as the default traction for a route is not a problem. In fact, I think the author would probably be quite appreciative of the fact that you chose their train in particular.
If you want to modify a train, include it with a route, or put it up for download somewhere, then you need permission.

If you have the program BRR then there is no point in me modifying a train or creating one. Just use one of the stock in your list.
